These Terms and Conditions ("Terms") govern your use of apogeeleadership.co and your relationship with Viera Professional Services LLC, dba Apogee Leadership ("Apogee Leadership", "we", "us").
By using this site or engaging our services, you agree to these Terms. If you do not agree, please do not use the site or services.
2. Who we work with
We provide leadership, coaching, and advisory services primarily to business owners and senior executives. Our services and content are not intended for consumer financial advice, medical advice, or legal advice. Any decisions you make based on our work remain your responsibility.
3. Use of the website
You agree to:
- Use the site only for lawful purposes.
- Not attempt to disrupt or gain unauthorized access to the site or underlying systems.
- Not copy, scrape, or republish content from the site without our written permission, except where clearly allowed (for example, downloading a resource we offer).
We may modify, suspend, or discontinue any part of the site at any time without notice.
4. Booking and services
When you book a call or engagement with us:
- You agree to provide accurate contact information.
- A booking does not guarantee that we will accept a longer-term engagement; both parties must agree to proceed.
- We may reschedule or decline meetings at our discretion (for example, if there is a conflict of interest).
Specific service terms (scope, fees, schedule, confidentiality obligations) will be set out in a separate proposal, engagement letter, or agreement.
5. No guarantees or professional warranties
Our role is to guide, advise, coach, and support decision-making, not to guarantee outcomes. While we aim to provide high-quality guidance based on experience and information available at the time:
- We do not guarantee particular business results (for example, revenue, profit, or valuation targets).
- You remain responsible for decisions you make and actions you take in your business.
The site and services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
6. Confidentiality and privacy
We treat coaching and advisory conversations as confidential and handle personal information in line with our Privacy Policy, which forms part of these Terms.
Key points:
- We collect the minimum information needed to deliver services.
- We do not sell or rent client data.

The site may link to or embed third-party services (for example, scheduling tools, video platforms, or payment providers). We do not control and are not responsible for:
- The content, policies, or practices of those third parties.
- Any damage or loss arising from your use of them.
Your use of those services is governed by their own terms and policies.

- We are not liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the site or services, including lost profits, revenue, or data.
- Our total liability for any claim related to the site or services will be limited to the amount you paid us for the relevant services in the 12 months before the claim arose (if any).
Some jurisdictions do not allow all of these limitations, so they may not apply to you in full.
10. Indemnification
You agree to indemnify and hold harmless Apogee Leadership and its members, employees, and contractors from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of:
- Your use of the site or services in violation of these Terms or applicable law.
- Any content or information you provide to us that infringes the rights of others.
11. Governing law and disputes
Unless otherwise agreed in writing:
- These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.
- Any disputes arising out of or relating to these Terms or our services will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction and venue.
We encourage resolving issues informally first, where possible.
